Commercial Litigation

The Commercial Litigation Team at Baldwins has had some recent successes in numerous matters including joint venture, partnership and insurance disputes.

Mediation has been a very useful tactic in some matters and Baldwins has just concluded appeals involving claims under the Trade Practices Act (TPA). The Commercial Litigation Team acts in all Trade Practices' Act matters including unconscionable conduct. Baldwins has also acted in a Corporations Law (ASIC) examination and our team represented a number of clients, involving director's duties and "white collar" related activities.

Mr Sam Recht heads Baldwins' commercial litigation team and has over 16 years experience in commercial litigation practice, including complex commercial disputes at all jurisdictional levels. He has handled joint venture and shareholder disputes, contractual franchise disputes, Trade Practices disputes, insolvency and debtor disputes, property law disputes and Corporations Law disputes. Sam is also an accredited LEADR mediator.

Baldwins in Historic Landmark Precedent IP Case

Baldwins acted in the leading landmark case on the law of passing off brought against its client the Windsor Smith group by Dr Martens Australia Pty Ltd.
